1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "Bo Lin" — Bo Lin Senior Living Residence, operating at 64 Nam Cheong Street, Sham Shui Po, Kowloon, Hong Kong.
• "Services" — the programmes and residential arrangements offered by Bo Lin, including Companion Circles, Cultural and Recreation Studio, and the Residence and Lifestyle Plan.
• "User" — any person who accesses our website or submits an enquiry through it.
• "Resident" — a person who has entered into a formal arrangement with Bo Lin to use one or more of the Services.
• "Agreement" — these Terms and Conditions, together with any written residence or programme agreement signed between Bo Lin and a Resident or their representative.

2. Acceptance of Terms

By using this website, submitting an enquiry, or entering into a residence arrangement with Bo Lin, you agree to these Terms and Conditions. If you are entering into an arrangement on behalf of another person (for example, an elderly parent), you confirm that you have the authority to do so.

These Terms apply to individuals aged 18 and over. Our Services are intended for older adults; use of this website implies you are at least 18 years of age.

3. Service Description

Bo Lin is a non-medical lifestyle community providing social, cultural and residential programmes for older adults in Sham Shui Po, Kowloon, Hong Kong. We do not provide clinical, nursing, medical or rehabilitation services. Residents who require medical support are responsible for arranging that separately through appropriate healthcare providers.

Services are available to residents who are independently mobile and do not require constant clinical monitoring. Availability is subject to capacity and Bo Lin's assessment at the time of enquiry.

4. User Responsibilities

When using our website or communicating with our team, you agree to:

• Provide accurate information in enquiry forms and communications
• Not use the website for any unlawful purpose
• Not submit false enquiries or misrepresent your circumstances
• Treat our staff with respect in all communications

5. Intellectual Property

All content on this website — including text, images, layout and design — is the property of Bo Lin or is used with permission. You may not reproduce, copy, distribute or commercially exploit any part of the website without written permission from Bo Lin.

6. Payment Terms

All fees are quoted in Hong Kong Dollars (HKD). Monthly programme and residence fees are payable in advance on the first day of each calendar month. Bo Lin accepts payment by bank transfer. Specific payment arrangements will be set out in the written residence or programme agreement.

Fees may be revised with a minimum of 30 days' written notice. Notice will be provided by email or letter to the contact address on file.

Refunds are not available for programme fees once a month has commenced. For the Residence and Lifestyle Plan, departure with less than 30 days' notice will result in a one-month fee being retained in lieu of notice, unless waived at Bo Lin's discretion due to exceptional circumstances.

7. Residence and Programme Terms

Companion Circles and Cultural Studio

These programmes operate on a monthly rolling basis. A minimum of one month's participation is required. Participation is voluntary on a session-by-session basis; enrolment does not require attendance at any specific number of sessions per month.

Residence and Lifestyle Plan

A minimum initial stay of one month is required. Following the initial month, the arrangement continues on a rolling monthly basis. Either party may terminate with 30 days' written notice. The Resident or their nominated representative must sign a written Residence Agreement before the commencement of the stay.

Bo Lin reserves the right to terminate a residence arrangement in the event of conduct that is harmful to other residents, staff, or the wellbeing of the community, or where the Resident's care needs exceed the scope of what Bo Lin provides.

8. Disclaimers

Bo Lin makes no clinical, medical or health-outcome representations regarding its Services. Our programmes are designed for lifestyle, social and cultural purposes only. We cannot and do not guarantee specific outcomes for any Resident's wellbeing, health or quality of life.

9. Limitation of Liability

To the extent permitted by Hong Kong law, Bo Lin's liability to any User or Resident arising from these Terms or the use of our Services shall be limited to the fees paid to Bo Lin in the preceding three months. Bo Lin shall not be liable for indirect, consequential, or special losses of any kind.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify Bo Lin against any claims, losses or expenses arising from your breach of these Terms or your misuse of our website or Services.

11. Termination

Bo Lin may suspend or terminate access to website services or programme enquiries at any time if we believe these Terms have been breached. For residential arrangements, termination procedures are set out in the written Residence Agreement.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising from these Terms or our Services shall first be referred for informal resolution through direct communication with our Residence Director. If unresolved, disputes shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.

13. General Provisions

These Terms constitute the entire agreement between you and Bo Lin in relation to website use. If any provision is found to be unenforceable, the remaining provisions will continue in effect. Our failure to enforce any provision at a given time does not waive our right to enforce it later.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of our website following an update constitutes acceptance of the revised Terms.
